CONDITIONS OF SALE

1. PARTIES AND SCOPE

These Conditions of Sale ("Conditions") govern all sales of products made through the Saybeam website (https://saybeam.com) operated by Axelorn Group LLC, a limited liability company registered in the State of Wyoming, United States, with its registered office at 33 N Gould St, Sheridan, WY 82801, USA ("Saybeam," "we," "us," or "our").

These Conditions apply between Saybeam and any individual placing an order through the website ("Customer," "you"). By placing an order, you confirm that you have read, understood, and accepted these Conditions in full.

These Conditions complement our Terms of Service, Privacy Policy, Refund Policy, and Shipping Policy. In case of conflict between these Conditions and any other policy regarding a sale, these Conditions prevail.

2. CUSTOMER ELIGIBILITY

To place an order on Saybeam, you must:

  • Be at least 18 years old (or the legal age of majority in your country of residence)
  • Have full legal capacity to enter into a contract
  • Provide accurate, complete, and up-to-date information at checkout
  • Use the website for personal, non-commercial purposes

We reserve the right to refuse, cancel, or limit any order at our sole discretion, including in cases of suspected fraud, abuse, or breach of these Conditions.

3. PRODUCTS

Saybeam designs and sells shapewear and intimate apparel for personal use by adults, including the Sculpt Brief, a high-waist 360-degree compression brief.

Our products are garments. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition. A compression garment does not replace medical care or the advice of a licensed healthcare professional.

Product descriptions, images, and information are provided in good faith and to the best of our knowledge. Minor variations in colour, appearance, fabric, or packaging may occur and do not constitute grounds for return.

We reserve the right to modify or discontinue any product at any time without prior notice.

4. PRICING

Prices are displayed on the product page in the currency selected at checkout (typically USD for US customers).

Unless otherwise indicated:

  • US prices exclude state and local sales taxes, which may be added at checkout based on the shipping destination
  • International orders may be subject to customs duties, import taxes, and other fees, which are the sole responsibility of the Customer

Prices may change at any time without prior notice. The applicable price for an order is the one displayed at the moment the order is confirmed.

Promotional discounts, coupons, and bundle offers are subject to specific conditions stated at the time of the offer and may be modified or withdrawn at any time.

5. ORDER PROCESS AND FORMATION OF CONTRACT

To place an order, you must:

  1. Select your product(s) and add them to your cart
  2. Provide accurate billing and shipping information
  3. Choose a payment method
  4. Review your order and accept these Conditions
  5. Submit your order by clicking the confirmation button

Placing an order constitutes a binding offer to purchase. The sale contract is formed only when Saybeam confirms acceptance of the order by sending an order confirmation email.

Saybeam reserves the right to refuse or cancel any order, including but not limited to cases of:

  • Stock unavailability
  • Pricing errors or technical malfunctions
  • Suspected fraud or unauthorized payment
  • Previous abuse of our refund or returns policy
  • Orders that violate applicable laws

Once an order has entered the shipping preparation stage, it cannot be modified or canceled.

6. PAYMENT

We accept the payment methods displayed at checkout, which may include credit card, debit card, PayPal, Apple Pay, Google Pay, Shop Pay, and other secure options.

Payment is processed immediately at the time of order confirmation through secure third-party payment processors. Saybeam does not store full payment card information on its servers.

By placing an order, you authorize Saybeam and its payment processors to charge the total order amount to the payment method you provided.

In case of failed payment, late payment, or a chargeback initiated without prior contact with our customer service, Saybeam reserves the right to suspend or cancel the order, suspend your account, and recover any amounts owed by any lawful means.

7. DELIVERY

Delivery terms, estimated times, and fees are detailed in our Shipping Policy.

Risk of loss and damage to the products passes to the Customer at the time of delivery to the address provided at checkout.

It is the Customer's responsibility to provide a correct and complete delivery address. Saybeam is not liable for delays, losses, or additional fees resulting from incorrect or incomplete addresses.

8. RIGHT OF WITHDRAWAL AND REFUNDS

8.1 Returns and refunds. Returns and refunds are governed in full by our Refund Policy. Because our products are intimate garments worn next to the skin, and for reasons of health and hygiene, an item cannot be taken back once it has been received by a customer and worn, tried on, washed, opened, or unsealed. Such items cannot be returned or refunded in full. Where an item does not suit you, the only resolutions we can offer are a size exchange or a partial refund of your order, as set out in our Refund Policy.

8.2 UK consumers. If you are a consumer in the United Kingdom, you benefit from the statutory 14-day right of withdrawal described in our Refund Policy, subject to the health and hygiene exception that applies to unsealed or worn garments.

8.3 US consumers. Nothing in these Conditions limits your rights under applicable U.S. federal or state consumer protection laws.

9. PRODUCT QUALITY AND DISCLAIMERS

Saybeam warrants that its products conform to the description provided at the time of sale and are of satisfactory quality.

The Sculpt Brief is a firm compression garment. Fit, comfort, and results vary from person to person. Customer testimonials and reviews reflect individual experiences and do not constitute a guarantee of identical results.

If you are pregnant, have recently given birth, are recovering from surgery such as a caesarean, or have a medical condition affecting your abdomen or circulation, consult a licensed healthcare professional before wearing a compression garment. Discontinue use if you experience pain, numbness, or discomfort.

To the maximum extent permitted by law, Saybeam disclaims all other warranties, express or implied. Nothing in this section limits warranties that cannot be excluded under applicable consumer protection laws.

10. INTELLECTUAL PROPERTY

All elements of the Saybeam website and products (text, images, logos, designs, patterns, packaging, and brand assets) are the exclusive property of Axelorn Group LLC and are protected by copyright, trademark, and other intellectual property laws.

Purchase of a product does not grant you any rights to reproduce, distribute, or commercially exploit our intellectual property.

11. PERSONAL DATA

Personal data collected through the sales process is processed in accordance with our Privacy Policy, in compliance with applicable US privacy laws.

12. LIABILITY

To the maximum extent permitted by applicable law, Saybeam's total liability arising out of or in connection with any sale shall not exceed the total amount paid by the Customer for the order in question.

Nothing in these Conditions excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under applicable law

Saybeam is not liable for damages resulting from misuse of our products, failure to follow the care or wear instructions, or any factor outside our reasonable control.

13. FORCE MAJEURE

Saybeam is not liable for any delay or failure to perform its obligations caused by events outside its reasonable control, including natural disasters, pandemics, strikes, supply chain disruptions, carrier delays, governmental actions, or technical failures.

14. DISPUTE RESOLUTION

We encourage Customers to contact us first at contact@saybeam.com to resolve any dispute amicably.

If a dispute cannot be resolved amicably, disputes shall be resolved by the courts located in Sheridan County, Wyoming, USA, in accordance with Wyoming state law.

15. GOVERNING LAW

These Conditions are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles.

16. CHANGES TO THESE CONDITIONS

Saybeam reserves the right to modify these Conditions at any time. The applicable version is the one published on the website at the time the order is placed. Any modification will be communicated through the website with a revised "Last updated" date.

17. SEVERABILITY

If any provision of these Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
