Saybeam operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Saybeam uses Shopify to provide the Services.

These terms and conditions, along with all policies referenced herein (the "Terms of Service"), describe your rights and responsibilities when using the Services.

By using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Services.

SECTION 1 — ACCESS AND ACCOUNT

You represent that you are at least 18 years old (or the age of legal majority in your country of residence) and that you have full legal capacity to enter into these Terms.

If you use the Services, we may request information such as your email, shipping address, and payment details. You guarantee that this information is correct and complete.

You are responsible for the security of your account and all activities conducted under it.

SECTION 2 — OUR PRODUCTS

We do our best to accurately represent our products, but colours and appearance may vary depending on your device.

Saybeam products are shapewear and intimate apparel intended for personal use by adults, including the Sculpt Brief, a high-waist 360-degree compression brief. They are garments. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition. A compression garment does not replace medical care or the advice of a licensed healthcare professional.

Results may vary from person to person. Customer testimonials do not guarantee identical results.

We reserve the right to modify or discontinue products at any time without notice.

SECTION 3 — ORDERS

By placing an order, you make an offer to purchase. Saybeam may accept or refuse the order at its sole discretion.

An order is only confirmed after payment is processed.

Once an order is being prepared for shipment, it cannot be modified or canceled.

SECTION 4 — PRICING AND PAYMENTS

Prices may change without prior notice.

Prices are listed in the currency displayed at checkout (typically USD for US customers) and do not include applicable taxes, shipping, or duties unless otherwise indicated.

You agree to provide accurate and up-to-date payment information.

SECTION 5 — SUBSCRIPTIONS

5.1 Subscription Agreement

If you select "Subscribe and Save," you agree to a recurring subscription.

You AUTHORIZE Saybeam to automatically charge your payment method every 30 days until cancellation.

5.2 Pricing

Subscriptions include a discount (for example, 15%). Prices may change with 14 days' prior notice.

5.3 Automatic Payments

Payment is processed automatically every 30 days.

You will receive an email reminder 3 days before each renewal.

If you do not cancel in time, the charge will be processed.

5.4 Modifications

You can modify your subscription by contacting contact@saybeam.com.

Changes must be made at least 48 hours before the next billing cycle.

5.5 Cancellation

You can cancel at any time at no cost.

Cancellations must be made at least 48 hours before the next renewal.

5.6 Subscription Refunds

Orders that have already shipped are non-refundable, except in the case of a resolution that complies with our Refund Policy.

Chargebacks initiated without first contacting customer support may result in account suspension.

5.7 Pause

You may pause your subscription for up to 60 days.

5.8 Availability

We do not guarantee continuous product availability.

5.9 Acceptance

By subscribing, you accept all of the above terms.

SECTION 6 — SAFETY AND LIMITATIONS

The information provided through the Services is for general informational purposes only.

The Sculpt Brief is a firm compression garment. If you are pregnant, have recently given birth, are recovering from surgery such as a caesarean, or have a medical condition affecting your abdomen, skin, or circulation, consult a licensed healthcare professional before wearing it.

Discontinue use if you experience pain, numbness, tingling, or discomfort. If you are new to firm compression, we recommend starting with a few hours a day and building up gradually. Please follow the care and wear instructions on the label to keep the garment in good condition, and keep the product away from young children.

SECTION 7 — SHIPPING

Delivery times are estimates and are not guaranteed.

We ship to addresses in the United States and to selected international destinations. Customs duties, import taxes, or other fees may apply to international orders and are the responsibility of the customer.

We are not responsible for delays caused by carriers, customs, or events outside our control.

SECTION 8 — REFUNDS AND CONSUMER RIGHTS

Returns and refunds are governed in full by our Refund Policy. Because our products are intimate garments worn next to the skin, and for reasons of health and hygiene, an item cannot be taken back once it has been received by a customer and worn, tried on, washed, opened, or unsealed. Such items cannot be returned or refunded in full. Where an item does not suit you, the only resolutions we can offer are a size exchange or a partial refund of your order. Original shipping fees are non-refundable.

US CONSUMER RIGHTS: Nothing in these Terms limits your rights under applicable U.S. federal or state consumer protection laws.

SECTION 9 — INTELLECTUAL PROPERTY

All content on the Services, including text, images, logos, designs, videos, and brand assets, is owned by Axelorn Group LLC (Saybeam).

Copying, reproducing, or using this content without prior written authorization is strictly prohibited.

SECTION 10 — THIRD-PARTY TOOLS

We are not responsible for the operation, accuracy, or safety of any external tools accessed through the Services.

SECTION 11 — EXTERNAL LINKS

We are not responsible for the content or practices of third-party websites linked from the Services.

SECTION 12 — SHOPIFY

Saybeam uses Shopify as its e-commerce platform. However, Shopify is not the seller and is not responsible for sales transactions.

SECTION 13 — PRIVACY

Your personal data is processed in accordance with our Privacy Policy.

SECTION 14 — FEEDBACK

By submitting feedback, comments, photos, videos, or other content to Saybeam, you grant us the right to use that content for marketing and operational purposes, including reviews, social proof, and promotional materials.

The use of automated tools, bots, scrapers, or any similar technology to access or interact with the Services must be explicitly disclosed and authorized in writing by Saybeam.

SECTION 18 — TERMINATION

We may terminate or suspend your access to the Services at any time, without notice, for any reason, including for violation of these Terms.

SECTION 19 — DISCLAIMER OF WARRANTIES

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, except for any warranties that cannot be excluded under applicable consumer protection laws.

We do not guarantee specific results from the use of our products.

SECTION 20 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Saybeam shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

SECTION 21 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Saybeam and its affiliates from any claims, damages, losses, liabilities, or expenses arising out of your use of the Services or your violation of these Terms.

SECTION 22 — FORCE MAJEURE

We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, pandemics, government actions, or supply chain disruptions.

SECTION 23 — SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

SECTION 24 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Saybeam regarding the Services.

SECTION 25 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent. Saybeam may assign its rights and obligations at any time.

SECTION 26 — GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the courts located in Sheridan County, Wyoming.

SECTION 27 — CHANGES

We may update these Terms at any time. Updated Terms will be posted on this website with a revised "Last updated" date. Continued use of the Services after changes constitutes acceptance of the updated Terms.
